Cause Of Injury: Negligence/Motors Vehicles/Collision While Trying to Pass Construction Vehicle. On June 17, 2010, plaintiff Eduard Kennedy was operating a motor vehicle on Highway 43 when he attempted to pass a construction vehicle (a motor grader) being operated by defendant Stuart McQuaid Campbell, Jr., for defendant Tomlin Construction, LLC. The construction vehicle was blocking the northbound lane. As plaintiff was passing on the left, the construction vehicle turned left into plaintiff’s minivan.

Plaintiff filed a complaint against Campbell and Tomlin on Aug. 20, 2010. Defendants claimed that Campbell had the right of way and that plaintiff was negligent in attempting to pass the motor grader in a no passing zone.

Nature Of Injury: Broken jaw; fractured right femur requiring surgical implantation of hardware; pain and suffering.
