Cause Of Injury: Medical Malpractice/Anesthesiology/Failure to Notify Surgeon of and Correct Respiratory Emergency. On Feb. 6, 2013, Philip Maness was undergoing an endoscopic procedure known as transurethral resection of the prostate. During the procedure, his bladder became perforated and surgical irrigation fluid leaked into his abdominal cavity. The fluid began to put pressure on his lungs and ventilator resulting in cardiopulmonary failure and death.

Plaintiff Kathi Maness, personal representative of the Estate of Philip Maness, filed a medical malpractice action against defendants Edward Maybury, M.D., and Anesthesia Consultants, P.A. Plaintiff claimed that Dr. Maybury, the anesthesiologist on the decedent’s surgery, failed to properly monitor his vital signs and timely alert his urological surgeon of the complication.
