Illinois Federal Jury Returns $ 9 Million MedMal Verdict For Widower Of Pregnant Patient That Died While Hospitalized For Pneumonia
On Feb. 26, 2010, Lashon Bilbro-Beverly was a 40-year-old female that was 32 weeks pregnant with her 7th child. She presented to the Emergency Department of Norwegian American Hospital, complaining of shortness of breath and cough. She was diagnosed with pneumonia and admitted to the general medical floor of the hospital. Between 5:30 p.m. and 9:45 p.m. on Feb. 27, 2010, Lashon allegedly communicated to nursing staff that her condition was worsening and she was very short of breath. At around 9:45 p.m., Lashon was found unresponsive. Cardiopulmonary resuscitation was attempted but was unsuccessful and Lashon was declared dead at approximately 11:03 p.m. Her unborn child, Jordan Kaleb Bilbo-Beverly, had been delivered via emergency cesarean section at around 10:30 p.m., but was stillborn upon delivery and was declared dead after 20 minutes of attempted resuscitation. The results of Lashon's autopsy showed that her death was caused by severe bilateral acute bronchopneumonia with pulmonary alveolar damage.
Plaintiff Eric Beverly, as administrator of the Estates of Lashon and Jordan, filed a medical malpractice action in the United States District Court for the Northern District of Illinois against The United States of America and Norwegian American Hospital on Sept. 11, 2012, claiming that defendants were negligent by failing to order an examination of Lashon prior to her death; failing to place her in intensive care; failing to place her in the left lateral position after a Code Blue was initiated; and failing to initiate a caesarean section delivery five minutes after the Code Blue. On May 5, 2016, the jury returned a $ 9,000,000 verdict for plaintiff, and Judge John Blakey entered a $ 9,000,000 judgment for plaintiff on May 10, 2016.
