Defendants' motion to dismiss was granted in a derivative action that was commenced after Medtronic Incorporated voluntarily removed its product, the Sprint Fidelis lead from the market in 2007. Plaintiff, on behalf of Medtronic, had alleged that defendants were liable for breach of fiduciary duty, abuse of control, gross mismanagement, insider trading, and aiding and abetting breaches of fiduciary duty.
