Cancellation Victory at Eloy, Arizona

"As was found by the BIA in Monreal, so this Court also finds in this case, that there is no question that respondent has a close-knit bond with his wife and children.  His children love him greatly and are experiencing emotional hardship due to his absence from the home. It is also clear that his financial contribution to the home was vital to the running of the home, with his wife also being employed.  When this Court takes into consideration in the aggregate, the hardship that the respondent's children would suffer if he were to be removed, it finds that the medical condition currently being experienced by _ for which she has a treatment plan, rises to the level of the requisite hardship.  Accordingly, the CourI issues the following order. ORDERS: Cancellation of Removal application is GRANTED." - Matter of X-, Oct. 4, 2013.  (ICE waived appeal.)  [Hats off to Mac Nayeri!]
