Form 9089 Focus Group - Drafting Tool, Degree Equivalency Tips

A Tool for Drafting Form 9089, including degree equivalency drafting tips for EB2 & EB3

The editors of IMMIGRATION LAW AND PROCEDURE, the premier immigration law treatise cited by U.S. federal courts, announce the formation of a Focus Group to review and beta test a new tool that can be used to assist attorneys when drafting a Form 9089 application for PERM labor certification.

The 9089 Focus Group will be administered by Ron Wada, co‐author of the Treatise, and co‐author of the quarterly series of articles, “Shaping the Future of PERM,” which reviews significant decisions issued by BALCA for publication in Bender’s Immigration Bulletin on a quarterly basis.

The new tool will be incorporated into the Treatise and will use the Form 9089 to organize practice tips and citations to Treatise analysis, regulations, and relevant PERM FAQs. Members of the 9089 Focus Group will be asked to review the tool at various stages of development and offer suggestions for how it could be improved. As envisioned, the tool would be updated periodically to reflect the current state of authority as well as the Focus Group’s collective understanding of best practices.

The benefits of participation:

- Sharing the latest information on PERM adjudication trends at DOL and BALCA, as well as best practices with a network of attorneys;
- A forum for gathering advice on case specific issues (Ron will coordinate submission of case questions for consideration by the full 9089 Focus Group);
- Integration with related degree equivalency 9089 drafting expertise provided by Treatise coeditor Ron Wada;
- A tool that they can use in their own practice and to help train associates.
