On July 1, 2014, the U.S. Court of Appeals for the Fifth Circuit published an important opinion regarding CAT (Convention Against Torture,) Garcia v. Holder, No. 13-60381.
I went to PACER and discovered that the petitioner was pro se!
PACER also indicated that Garcia had been locked up at the South Texas Detention Complex in Pearsall, Texas (about 56 miles south of San Antonio.)
I checked the ICE detainee locator, but it shows that Garcia is no longer detained. Was he deported? Was he released on bond?
I called the OIL attorneys on the case, Joanna Leigh Watson, 202-532-4275, and Don George Scroggin, 202-305-2024, but they refused to say where Garcia is. (Scroggin claimed he didn't know.)
PACER now shows that on August 4th, OIL filed a motion to modify the July 1st opinion. CA5 granted the motion on Aug. 8th, the same day that Proposed Amici Curiae University of Houston Immigration Clinic, Immigrant Rights Clinic, Washington Square Legal Serv., National Immigration Project and the Post-Deportation Human Rights Project filed motions. (All the motions are locked on PACER to all but the parties.)
