"The opinion, concurrence, and dissent filed November 19, 2019, and published at 942 F.3d 945 are amended by the opinion, concurrence, and dissent filed concurrently with this order. With this amendment, Judges W. Fletcher and Christen have voted to deny respondent’s petition for rehearing en banc (Dkt. Entry 57). Judge Callahan has voted to grant the petition for rehearing en banc. The full court has been advised of the petition for rehearing en banc. A judge requested a vote on whether to rehear the matter en banc. The matter failed to receive a majority of votes of the nonrecused active judges in favor of en banc consideration. Fed. R. App. P. 35(f). The petition for rehearing en banc is DENIED. No further petitions for panel rehearing or rehearing en banc may be filed."
