NEW YORK - A New York appellate panel on April 23 found that the safe harbor from copyright infringement afforded to online service providers by the Digital Millennium Copyright Act (DMCA) does not apply to works fixed before 1972, in light of the guidelines of the Copyright Act (UMG Recordings Inc. v. Escape Media Group Inc., No. 100152/2010, N.Y. Sup., App. Div., 1st Dept.; 2013 N.Y. App. Div. LEXIS 2642; 2013 NY Slip Op 2702; See 7/16/12, Page 7).
