New York State Jury Awards $11.6M In Medical Malpractice Action Against Radiologist

On Jan. 25, 2012, Kevin Orr arrived at the Emergency Department at Glens Falls Hospital, with a documented history of dizziness, headache, and inability to stand. A CT scan was ordered and read by radiologist James E. Bell, M.D., of Adirondack Radiology Associates, P.C. The CT scan allegedly showed that a blood vessel supplying blood to his brain was blocked, but Bell did not report any such condition to the emergency room physician. As a result of this alleged failure, the stroke was not diagnosed and Orr was not prescribed blood-thinning drugs that would have prevented a future, more damaging, stroke. Orr was sent home with a diagnosis of a sinus infection. He suffered a massive debilitating stroke several weeks later.

On Aug. 20, 2012, Orr filed a medical negligence action in the New York Supreme Court for Warren County. He named as defendants a number of medical providers, including Dr. Bell, Adirondack Radiology, Glens Falls Hospital, Orr's primary care physician, and two physician's assistants. The action was ultimately assigned to Judge Thomas Buchanan. Prior to trial, Orr settled with the hospital, primary care physician's office, and two physician assistants for $ 900,000.00.

On Feb. 1, 2016, the remaining claims against Dr. Bell and Adirondack Radiology proceeded to trial. On Feb. 4, 2016, the jury of five women and one man reached a verdict in Orr's favor, assessing 100 percent of the liability to Dr. Bell and finding that Bell's malpractice was a substantial factor in causing the injuries and damages suffered by Kevin Orr. The award totaled around $11.6 million and included past, present, and future pain and suffering damages of $8.5 million.
