Judge: Insurer Has No Duty To Defend Suits Alleging $2.6M Kickback Scheme

SCRANTON, Pa. - An insurer has no duty to defend or indemnify its insureds against underlying lawsuits alleging that the insureds participated in a $2.6 million kickback scheme with two Pennsylvania judges, a Pennsylvania federal judge ruled March 7, granting the insurer's motion for summary judgment (Markel International Insurance Company v. Western PA Child Care LLC, et al., No. 3:10-CV-1156, M.D. Pa.; 2012 U.S. Dist. LEXIS 31361).
