Judge: Plaintiff In Derivative Lawsuit Failed To Show Presuit Demand Was Futile

RENO, Nev. - A federal judge in Nevada on March 14 dismissed a shareholder derivative lawsuit because, as in a previous and essentially identical shareholder derivative lawsuit, the plaintiff had failed to show that presuit demand upon a company's board of directors would have been futile (Lawrence Arduini v. Patti S. Hart, et al., No. 11-cv-00255, D. Nev.; 2012 U.S. Dist. LEXIS 34979).
