7th Circuit: Failure To Fulfill Policy Duties Defeats Claims Against Insurer

CHICAGO - A Seventh Circuit U.S. Court of Appeals panel on March 16 ruled that because an Indiana couple did not comply with their insurer's documentation requests, which required "duties after loss" under their homeowners policy, their claims for breach of contract and bad faith against the insurer were properly dismissed by a trial court (Harry Foster III, et al. v. State Farm Fire and Casualty Co., No. 11-3100, 7th Cir.; 2012 U.S. App. LEXIS 5513).
