Judge Says Dukes Does Not Prevent Certification Of Smokers' Monitoring Class

BOSTON - The U.S. Supreme Court's recent decision in Wal-Mart Stores, Inc. v. Dukes (131 S. Ct. 2541 (2011) does not justify decertification of a class of smokers seeking medical monitoring to check for incipient cancers, a Massachusetts federal judge ruled March 21 (Kathleen Donovan, et al. v. Philip Morris USA, Inc., No. 1:06cv12234, D. Mass.).
