INDIANAPOLIS - A former employee of a Fortune 500 diesel engine and power company established a prima facie case of hostile work environment due to race- and disability-based harassment and retaliation for reporting the harassment, an Indiana federal judge held March 26 in denying the company's motion for summary judgment (Adrian Jenkins v. Cummins, Inc., No. 1:10-cv-313, S.D. Ind.; 2012 U.S. Dist. LEXIS 40667).
