5th Circuit Affirms Ruling Finding Bank Had Authority To Foreclose

NEW ORLEANS - A Fifth Circuit U.S. Court of Appeals panel on March 27 affirmed a judge's decision to award summary judgment to defendants in a foreclosure action after finding that the documents submitted by Bank of New York established that it possessed the original promissory note and deed of trust to the plaintiff's loan (Joseph Kiggundu v. Mortgage Electronic Registration Systems Inc., et al., No. 11-20533, 5th Cir.).
