New Jersey Federal Judge Dismisses Class Action Secondary Payer Suit

TRENTON, N.J. - A federal judge in New Jersey on March 23 dismissed a putative class action against Kathleen Sebelius, secretary of Health & Human Services (HHS), and the Centers for Medicare and Medicaid Services (CMS) challenging CMS's right to seek reimbursement from Medicare beneficiaries under the Medicare Secondary Payer (MSP) provisions following a lump-sum tort settlement (Joseph B. Mason v. Kathleen Sebelius, et al., No. 11-2370, D. N.J.; 2012 U.S. Dist. LEXIS 40592).
