Federal Circuit Affirms Indefiniteness Finding In Infusion Patent Case

WASHINGTON, D.C. - A Maine federal judge did not err in determining that the terms "control means" and "programmable control means" as they appear in a patent relating to fluid infusion are indefinite, a divided Federal Circuit U.S. Court of Appeals held March 26 (Ergo Licensing LLC v. Carefusion 303 Inc., No. 11-1229, Fed. Cir.).
