Judge Dismisses Claims Against Maker Of Allegedly Moldy Washing Machines

TRENTON, N.J. - A New Jersey federal judge on March 27 partially granted a motion to dismiss filed by the manufacturer of allegedly defective washing machines of fraud claims asserted under New Jersey and California law by a consumer who filed a putative class action alleging that the machines smell of mold and mildew after use (Daisy Montich v. Miele USA Inc., No. 11-02725,  No. 11-02725, D. N.J.; 2012 U.S. Dist. LEXIS 41398).
