Federal Judge: Insured's Ensuing Losses From Faulty Workmanship Are Covered

GAINESVILLE, Fla. - An insured's ensuing losses resulting from faulty workmanship are covered under primary and excess insurance policies, a Florida federal judge determined March 30, also finding that the consequential loss exclusions bar coverage for lost rents, loan expenses and diminution of value, but not the costs of retaining experts (The Bartram LLC v. Landmark American Insurance C o., et al., No. 10-28, N.D. Fla.; 2012 U.S. Dist. LEXIS 44535).
