2 Counterclaims Dismissed Against Insurers In Environmental Coverage Suit

BIRMINGHAM, Ala. - An Alabama federal magistrate judge on April 5 dismissed an industrial operator insured's counterclaims for breach of the enhanced obligation of good faith and breach of fiduciary duty against its general liability insurers but refused to dismiss or strike the remaining counterclaims at issue in a lawsuit challenging coverage for alleged injuries and damages caused by industrial emissions (St. Paul Fire and Marine Insurance Co., et al. v.
