Judge Allows Counterclaims Against Railroad In Asbestos-Fraud Case

WHEELING, W.Va. - Lawyers who were sued for allegedly filing thousands of asbestos claims without regard for their merit may proceed with counterclaims that a railroad misrepresented the damages it incurred defending one of the claims and failed to disclose material evidence, a West Virginia federal judge held April 25 (CSX Transportation Inc. v. Robert V. Gilkison, et al., No. 05-202, N.D. W.Va.; 2012 U.S. Dist. LEXIS 57429).
