WASHINGTON, D.C. - A product embodying the technology disclosed in a network communication patent was offered for sale prior to the patent's critical date, a Federal Circuit U.S. Court of Appeals panel ruled May 8, upholding a lower court verdict and judgment that found the patent to be invalid as anticipated (Leader Technologies Inc. v. Facebook Inc., No. 2011-1366, Fed. Cir.; 2012 U.S. App. LEXIS 9347).
