PITTSBURGH - A Pennsylvania federal judge on May 9 conditionally certified a class of salaried workers age 50 and older who are alleging violations of the Age Discrimination in Employment Act (ADEA), finding that the act's provision that it protects individuals who are at least 40 does not preclude subgroups limited to older workers (Rudolph A. Karlo, et al. v. Pittsburgh Glass Works, LLC, No. 10-1283, W.D. Pa.; 2012 U.S. Dist. LEXIS 64801).
