Republic Of Namibia's Agency Is Not Immune From Tort Suit, 2nd Circuit Affirms

NEW YORK - The Second Circuit U.S. Court of Appeals on May 25 affirmed a lower court's ruling that an instrumentality of the Republic of Namibia is not immune from an insurer's subrogation tort lawsuit based on its purported failure to comply with the New York City Building Code (USAA Casualty Insurance Co. v. Permanent Mission of the Republic Of Namibia, et al., No. 10-4892-cv, 2nd Cir.; 2012 U.S. App. LEXIS 10688).
