Insurance Companies Relieved Of Duty To Defend In Illinois Water Utility Suit

CHICAGO - A unanimous First District Appellate Court, Fifth Division, panel announced an opinion May 31 overturning a declaratory judgment against insurance companies that they owe a duty to the former mayor of Crestwood, Ill., to defend in underlying lawsuits alleging that Crestwood and its officials provided contaminated water to village residents; summary judgment was entered for the insurance companies (Metropolitan Property & Casualty Insurance Co., et al. v. Chester Stranczek, No. 10-3760, Ill. App., 1st Dist., 5th Div.).
