GRETNA, La. - The Louisiana Fifth Circuit Court of Appeal panels issued two related opinions May 31 in an action alleging personal injuries claims for exposure to naturally occurring radioactive material at a Harvey, La., oil extraction maintenance facility; judgment for the defendants under the statute of limitations was overturned in one opinion, and a $1.1 million judgment for 16 plaintiffs was affirmed in the second opinion (Olivia Bailey, et al. v. ExxonMobil Corp., et al., No. 11-459, La. App. 5th Cir.; 2012 La. App. LEXIS 749; Warren Lester, et al. v. ExxonMobil Corp., et al., No. 10-743, La. App. 5th Cir.; 2012 La. App. LEXIS 784).
