Georgia Federal Judge: Woman With Arthritis Not Qualified For Cashier Job

ATLANTA - A national drugstore chain did not discriminate against one of its cashiers when it fired her because she could not perform the essential functions of her job due to her arthritis and therefore is not a "qualified individual" under the Americans with Disabilities Act (ADA) 42 U.S.C.S. § 12101 et seq., a Georgia federal judge held July 9 (Equal Employment Opportunity Commission v. Eckerd Corporation d/b/a Rite Aid,  No. 1:10-cv-2816, N.D. Ga.; 2012 U.S. Dist. LEXIS 94474).
