Magistrate Judge Allows Suit Over Lender's Refusal To Rescind Loan To Stand

HONOLULU - A federal magistrate judge in Hawaii on July 31 denied Bank of America N.A.'s motion to dismiss a couple's amended lawsuit alleging that the lender violated the Truth in Lending Act (TILA) 15 U.S.C.S. § 1601, and Hawaii's state law governing unfair and deceptive business practices after finding that the plaintiffs sufficiently pleaded their claims (Graham, et al. v. Bank of America, N.A, No. 11-00546, D. Hawaii, 2012 U.S. Dist. LEXIS 106443).
