Federal Judge: HHS Vacates Calculation Of Reimbursement Rates

WASHINGTON, D.C. - A federal judge in the U.S. District Court for the District of Columbia on Nov. 15 vacated and remanded to the U.S. Department of Health and Human Services (HHS) a department policy regarding the calculation of a disproportionate share of low-income patients without private health insurance. The federal judge determined that the 2004 rule at issue introduced a new way of calculating such rates in violation of the Administrative Procedure Act (APA) and the Medicare Act (Allina Health Services, et al., v. Kathleen Sebelius, Secretary, U.S. Department of Health and Human Services,  No. 10-1463, D. D.C.; 2012 U.S. Dist. LEXIS 163238).
