ABINGDON, Va. - A motion to dismiss for failure to state a claim or, alternatively, for lack of jurisdiction by the U.S. District Court for the Western District of Virginia was denied in an order entered Jan. 3 in a property damage lawsuit alleging that a coal company damaged coalbed methane reserves by storing produced water in mine voids (Robert S. Powers, et al. v. Consolidation Coal Co., No. 12-39, W.D. Va.; 2013 U.S. Dist. LEXIS 826).
