ATLANTA - An 11th Circuit U.S. Court of Appeals panel on Jan. 10 affirmed a lower court decision holding that a state law prohibiting Florida physicians from referring their patients for services to business entities in which the referring physicians have a financial interest is not preempted by federal law or unconstitutional (Fresenius Medical Care Holdings Inc., et al. v. Elisabeth Tucker, M.D., et al., No. 11-14192, 11th Cir.; 2013 U.S. App. LEXIS 716).
