Declaratory Judgment Patent Action Erroneously Rejected, Federal Circuit Says

WASHINGTON, D.C. - A Pennsylvania federal judge's refusal to entertain a declaratory judgment patent action or to allow the declaratory judgment plaintiff leave to add claims was in error, the Federal Circuit U.S. Court of Appeals ruled Feb. 5 (Arkema Inc., et al. v. Honeywell International Inc., No. 12-1308, Fed. Cir.).
