Panel Finds Tort Bad Faith Claim, Damages Not Available Under Tennessee Law

NASHVILLE - Because the plaintiffs in a coverage dispute over an accident caused by an unlicensed minor based their bad faith claim in tort rather than the state's bad faith penalty statute, a Tennessee appeals panel on March 4 unanimously vacated a lower court's judgment on that point and accompanying damages awards (Wendy Leverette, et al. v. Tennessee Farmers Mutual Insurance Co., No. M2011-00264-COA-R3-CV, Tenn. App.; 2013 Tenn. App. LEXIS 161).
