CHICAGO - An employer can recover out of a third-party settlement the entire amount of workers' compensation benefits paid to an employee, including the $145,018.71 paid to the employee by the employer's insolvent workers' compensation insurer and the $120,186 ordered by a trial judge to be paid directly to a state insurance fund, an Illinois appeals court held March 7 (Raul Sanchez v. Rental Service Corp., Nos. 1-08-3304; 1-09-0165; 1-09-0188, Ill. App. Div., 1st Dist., Div. 4; 2013 Ill. App. Unpub. LEXIS 411).
