Magistrate Judge Finds Government Properly Asserted Deliberative Process Privilege

TRENTON, N.J. - A federal judge in New Jersey on March 19 granted the majority of a motion for a protective order filed by the federal government in a $24 million Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) lawsuit, after finding that it properly asserted the deliberative process privilege over the documents (United States of America av. Pechiney Plastics Packaging In., No. 09-5692, D. N.J.; 2013 U.S. Dist. LEXIS 37640).
