Judge Dismisses Insurer's Indemnity Claim, Allows Duty To Defend Claim

MONTGOMERY, Ala. - An insurance company may pursue its claim against an insured and homeowners for a declaration regarding its duty to defend a construction defect case, an Alabama federal judge ruled May 7; however, the judge dismissed the insurer's claim regarding its duty to indemnify as premature (Pennsylvania National Mutual Casualty Insurance Co. v. Watts Builders LLC, et al., No. 12-994, M.D. Ala.; 2013 U.S. Dist. LEXIS 64813).
