3rd Circuit Adopts Transformative Use Test In Right Of Publicity Case

PHILADELPHIA - In resolving disputes that pit a plaintiff's right of publicity against a defendant's First Amendment rights, the Third Circuit U.S. Court of Appeals on May 21 adopted copyright law's transformative use test, deeming the approach "most appropriate" (Ryan Hart, individually and on behalf of all others similarly situated v. Electronic Arts Inc., No. 11-3750, 3rd Cir.).
