Magistrate: Reinstatement Of Hurricane Ike Coverage Suit 'Would Be Futile'

GALVESTON, Texas - An insured failed to submit the legally required proof of loss for additional benefits under her federal flood insurance policy, and, therefore, reinstatement of her complaint seeking coverage for Hurricane Ike damage would be futile, a federal magistrate judge ruled June 26 (Holly Cooper-Roell v. Fidelity National Property and Casualty Insurance Co., No. G-10-359, S.D. Texas, 2013 U.S. Dist. LEXIS 89520).
