Judge Remands Negligent Misrepresentation Lawsuit Against Insurance Agent

SACRAMENTO, Calif. - An insurance agent was not fraudulently joined to a breach of fiduciary duty and negligent misrepresentation lawsuit concerning coverage for an insured's property loss, a California federal judge ruled July 5, declining to dismiss the agent and, instead, remanding the case to state court (Clarklift West d/b/a Team Power Forklift v. Sentry Select Insurance Co., et al., No. 13-00815, E.D. Calif.; 2013 U.S. Dist. LEXIS 94232).
