Insurer Is Responsible For Insurance Agent's Violations, Washington High Court Says

OLYMPIA, Wash. - An insurer is responsible for its insurance agent's regulatory violations, pursuant to statutory and common-law theories of agency, a majority of the Washington Supreme Court held Aug. 1, finding that when the statute forbids the insurer or its agent from certain conduct, it means that the insurer may not do indirectly - through its agent - what it may not do directly (Chicago Title Insurance Co. v. Washington State Office of the Insurance Commissioner, No. 87215-5, Wash. Sup.; 2013 Wash. LEXIS 615).
