Judge Deems ISP Not 'Bona Fide,' Dismisses Spam Claims Against Kraft

GREENBELT, Md. - A Maryland federal judge on Aug. 12 concluded that both Maryland and California anti-spam statutes require an Internet service provider (ISP) to be a "bona fide" ISP to have standing to pursue federal claims against purported spammers (Beyond Systems Inc. v. Kraft Foods Inc., et al., No. 8:08-cv-00409, D. Md.; 2013 U.S. Dist. LEXIS 113064).
