9th Circuit: Consumer Can Amend Credit-Reporting Complaint

SAN FRANCISCO - The Ninth Circuit U.S. Court of Appeals on Aug. 13 affirmed the dismissal of a consumer's Fair Credit Reporting Act (FCRA) suit but reversed a district court's denial of his motion to file a second amended complaint (SAC), finding that the consumer in his proposed SAC adequately alleged that a bank did not meet its obligations under the statute (Dean Pace v. Bank of America Corp., et al., No. 11-57203, 9th Cir.; 2013 U.S. App. LEXIS 16752).
