Federal Judge Dismisses In Part Consumers' Suit Arising From Collection

RALEIGH, N.C. - A federal judge in North Carolina on Aug. 13 dismissed certain claims from a consumers' suit against a debt collector, finding that their North Carolina Unfair and Deceptive Trade Practices Act (UDPTA) claim is preempted to the extent that it is based upon furnishing inaccurate information to credit-reporting agencies (James Glenn, et al v. FNF Servicing, Inc., et al., No. 12-0703, E.D. N.C.; 2013 U.S. Dist. LEXIS 114138).
