5th Circuit Affirms Dismissal Of False Claims Suit Based On Implied Certification

NEW ORLEANS - The Fifth Circuit U.S. Court of Appeals on Aug. 20 affirmed, for a second time, dismissal of a False Claims Act (FCA) lawsuit in which the relator alleges that Cardinal Health Inc. fraudulently sold defective intravenous infusion pumps to Veterans Affairs hospitals (United States of America, ex rel. Leslie Steury v. Cardinal Health, Incorporated, et al., No. 12-20314, 5th Cir.; 2013 U.S. App. LEXIS 17381).
