1st Circuit Affirms Ruling Finding Property Description Did Not Void Mortgage

BOSTON - A First Circuit U.S. Court of Appeals panel on Aug. 30 affirmed the dismissal of a man's lawsuit seeking to enjoin Bank of New York Mellon (BONY) from foreclosing on his property after finding that the original description of the property in the mortgage documents satisfied New Hampshire's statute of frauds (Harold French v. Bank of New York Mellon, No. 12-2284, 1st Cir.; 2013 U.S. App. LEXIS 18166).
