4th Circuit Panel Affirms Black Lung Benefits Award Under Affordable Care Act

RICHMOND, Va. - A unanimous Fourth Circuit U.S. Court of Appeals panel issued a per curiam opinion Sept. 6 denying the petition of a coal company for leave to appeal a grant of black lung benefits under the rebuttable presumption of disability included in the Patient Protection and Affordable Care Act of 2010 (Westmoreland Coal Co. Inc. v. Director, Office of Workers' Compensation, U.S. Department of Labor, et al., No. 12-1879, 4th Cir.).
