Diversity Challenge Upheld In Iowa Lawsuit Alleging Off-Label Herbicide Application

CEDAR RAPIDS, Iowa - The complaint filed in July by an Iowa farmer seeking recovery of damages for off-label application of herbicides was dismissed Sept. 5 in the U.S. District Court for the Northern District of Iowa for lack of jurisdiction because the defendant's principal place of business is also Iowa and diversity between the parties is lacking, according to the presiding magistrate judge (Joel Kurtenbach v. Innovative Ag Services Co., No. 12-71, N.D. Iowa; 2013 U.S. Dist. LEXIS 127358).
