Okla. Appeals Court Affirms $15M Botox Botulism Verdict; Jury Wasn't Inconsistent

OKLAHOMA CITY - An Oklahoma state court jury did not reach a contradictory verdict when it found no product liability in a Botox botulism case but found defendant Allergan Inc. negligent for off-label promotion, a state appeals court panel ruled Sept. 9 in upholding a $15 million verdict (Sharla Helton v. Allergan, Inc., No. 139785, Okla. App., Div. 4).
