NEW YORK - A New York federal judge on Sept. 16 partially granted a motion for conditional certification of a collective action seeking wages on behalf of employees of a New York sushi restaurant who claim that their set salary, when divided by all the hours they worked, did not meet minimum wage requirements (Raymundo Mendoza, et al. v. Ashiya Sushi 5, Inc., et al., No. 12-8629, S.D. N.Y.; 2013 U.S. Dist. LEXIS 132777).
